TERMS

These Terms govern the use of giselle.art and the acquisition of works offered by GISELLE.

By using this website or completing an acquisition, you agree to the applicable provisions of these Terms.

THE WORK

GISELLE creates original paintings and photographic works presented through three distinct categories: Original, Fragment, and Edit.

ORIGINAL

Original paintings by GISELLE are singular 1/1 works.

An Original will not be reproduced as the complete artwork. Upon completed acquisition, the work becomes part of a private collection and is removed from availability.

FRAGMENT

Fragments are limited-edition photographic works created from original photography captured by GISELLE in the studio.

A Fragment preserves a photographic composition selected for the strength and exactness of its color, detail, and relationship to the original source.

Each Fragment is produced according to its defined edition.

EDIT

Edits are limited-edition works created through an artist-directed editing process using original studio photography as source material.

An Edit may involve intentional transformation of color, composition, proportion, scale, atmosphere, or other visual characteristics. The editing process results in a completed GISELLE work rather than a client-customizable reproduction.

Each Edit is produced according to its defined edition.

EDITIONS + ARTIST PROOFS

Edition information associated with a Fragment or Edit establishes the authorized edition for that work.

Where an Artist Proof is created, it exists separately from the numbered edition and will be identified accordingly. Artist Proofs are limited in availability and are hand-signed by GISELLE.

GISELLE retains control over the creation and availability of Artist Proofs.

CERTIFICATE OF AUTHENTICITY

Every Original, Fragment, and Edit is accompanied by a GISELLE Certificate of Authenticity.

The Certificate documents the identity and authenticity of the work and, where applicable, its edition information.

Limited-edition works may be fulfilled directly from the fine-art printer or production studio to the collector. A physical signature directly on a Fragment or Edit is not required for authenticity unless the work is specifically represented as hand-signed.

Artist Proofs are hand-signed.

The Certificate of Authenticity should be retained with the work as part of its provenance.

COPYRIGHT + OWNERSHIP

Acquiring a GISELLE work transfers ownership of the physical artwork or edition acquired.

Copyright does not transfer.

GISELLE retains all copyright, reproduction, licensing, publication, derivative-work, and other intellectual-property rights in the artwork and its imagery unless those rights are expressly transferred through a separate written agreement.

Acquisition of a work does not grant the right to reproduce it, create additional copies, manufacture products from it, license its image, create derivative works from it, or otherwise commercially exploit the artwork.

All artwork, photography, imagery, text, graphics, GISELLE branding, GSL branding, and other original material presented on giselle.art remain protected intellectual property.

ARTWORK IN INTERIORS

GISELLE welcomes the presence of the work within published and photographed interiors.

Collectors, interior designers, architects, photographers, publications, and other design professionals may photograph and share an acquired GISELLE work when it appears naturally as part of an interior, installation, project, or collection.

Such use may include portfolios, websites, social media, editorial coverage, project photography, press submissions, and design-award submissions.

Where credits are customary or reasonably practicable, attribution to GISELLE is requested.

This permission applies to documentation and presentation of the environment in which the work is installed. It does not grant permission to extract, reproduce, license, alter, distribute, or commercially exploit the artwork itself as a separate creative asset.

High-resolution reproduction or publication of the artwork itself requires prior authorization from GISELLE.

PERSONAL SHARING

Collectors may photograph and share their acquired GISELLE work for personal, noncommercial purposes, including social media.

Ownership of the physical work does not authorize production or distribution of reproductions, prints, merchandise, digital assets, or other derivative uses.

ARTIFICIAL INTELLIGENCE + DATASETS

No GISELLE artwork, photography, imagery, or other protected creative material may be intentionally copied, scraped, collected, reproduced, uploaded, licensed, or otherwise used for artificial-intelligence training, machine-learning training, generative systems, datasets, model development, image synthesis, style replication, or similar computational purposes without prior written authorization from GISELLE.

No such rights are granted through access to giselle.art or acquisition of a GISELLE work.

COLOR + DIGITAL DISPLAY

The artwork shown on giselle.art is presented digitally. The physical work exists within a different color environment.

Screens use transmitted light and vary by device, calibration, brightness, browser, and viewing conditions. Physical works are produced using their specified materials, inks, pigments, substrates, and print processes and are experienced through reflected light.

Accordingly, digital representations are intended to communicate the work accurately but cannot constitute an exact color proof of the physical artwork.

Differences inherent between screen display and physical production are not considered defects.

SCALE + DISPLAY

Artwork dimensions provided in connection with an individual work govern its physical size.

Interior placements, visualizations, mockups, photographs, and editorial presentations may be used to communicate scale, atmosphere, or placement and should not be interpreted as precise architectural or dimensional representations unless expressly identified as such.

ACQUISITION

Acquisitions are handled directly.

A typical acquisition may include inquiry, direct communication with GISELLE, confirmation of the work and applicable details, payment, fulfillment, tracking, and delivery.

An existing work is considered acquired when payment has been received in full. Until that time, availability is not guaranteed unless GISELLE has expressly agreed to reserve the work.

Once payment has been received in full, the acquisition is final and the work will be removed from availability as applicable.

COMMISSIONS

A commission is initiated upon agreement of its applicable terms and receipt of a 50% deposit.

The balance, timing, creative parameters, delivery, and any other conditions applicable to a commission will be established directly in connection with that commission.

Because commissioned work is created specifically following an engagement, commission deposits are non-refundable once work has commenced except where otherwise agreed in writing or required by law.

Creative direction and final artistic decisions remain with GISELLE unless expressly agreed otherwise.

RESERVES + ESTABLISHED RELATIONSHIPS

GISELLE may, at its discretion, consider temporary reserves, deposits, payment arrangements, or other acquisition accommodations for established collector and professional relationships.

No reserve or payment arrangement exists unless expressly confirmed by GISELLE.

An accommodation made for one acquisition does not establish an obligation or continuing policy for future acquisitions.

PRICING + DESIGN PROFESSIONALS

Unless otherwise expressly arranged, GISELLE artwork is offered at the established acquisition price regardless of whether the purchaser is a private collector or design professional.

Any fee, markup, procurement charge, resale arrangement, or other amount between a design professional and their client exists independently of GISELLE.

GISELLE retains discretion to establish separate terms for commissions, multiple-work acquisitions, commercial projects, hospitality projects, or other circumstances requiring individual consideration.

PAYMENT

Available payment methods are confirmed as part of the acquisition and may include Apple Pay, Zelle, or other methods accepted by GISELLE.

An acquisition is not complete because an invoice, payment request, or payment instruction has been issued. For existing works, acquisition occurs upon receipt of payment in full.

FINAL ACQUISITION

Because GISELLE works are singular originals, defined limited editions, or individually produced works, all acquisitions are final.

Returns, exchanges, or cancellations are not accepted for change of mind, placement, scale, preference, expected color based solely upon screen display, or other subjective considerations.

This does not apply to a verified production error, artwork received materially different from the work ordered, or rights that cannot legally be excluded.

PRODUCTION ERROR

If a Fragment or Edit contains a verified production error attributable to its production, GISELLE must be contacted promptly following delivery.

Where a production error is confirmed, GISELLE will determine the appropriate remedy, which may include replacement of the affected edition where replacement is possible.

Normal characteristics of fine-art materials and printing processes, including reasonable variation inherent in physical production, are not production errors.

SHIPPING

Domestic fulfillment is generally expected within three weeks following completion of the acquisition unless a different schedule is communicated for the particular work.

This timeframe is an estimate rather than a guaranteed delivery date. Production requirements, dimensions, materials, carrier schedules, or other circumstances may affect timing.

Tracking information will be provided when available.

International acquisitions and shipping arrangements are handled individually. Timing, carrier requirements, insurance, customs, and other conditions will be communicated as part of the acquisition process.

SHIPPING INSURANCE + DAMAGE

Shipping insurance is the responsibility of the purchaser and will be included or arranged as part of the applicable shipping requirements.

If artwork is damaged in transit, immediate action is required to preserve available insurance coverage.

The recipient should document the condition of the shipment and artwork upon discovery, retain all original packaging and shipping materials, photograph the packaging and damage, and comply promptly with the carrier's and insurer's claim requirements.

Claims for shipping damage are made against the applicable shipping insurance. The purchaser is responsible for pursuing and collecting an insurance claim where the policy or carrier requires the purchaser to do so.

GISELLE will provide reasonably available documentation necessary to support a legitimate claim but does not assume the insurer's obligations or guarantee payment of a claim.

INTERNATIONAL ACQUISITIONS

Unless otherwise expressly agreed, the recipient of an international shipment is responsible for applicable customs duties, VAT, import taxes, brokerage charges, governmental assessments, and other destination-related fees.

International requirements vary by destination and will be addressed individually where appropriate.

AVAILABILITY

GISELLE endeavors to keep availability current.

A work displayed as available is not considered sold or reserved until the applicable acquisition requirement has been satisfied or GISELLE has expressly confirmed a reserve.

If competing acquisition requests occur before payment is completed, availability will be determined by the first completed acquisition unless GISELLE has previously confirmed another arrangement.

WEBSITE USE

giselle.art and its contents are provided for viewing, inquiry, acquisition, professional reference, and engagement with GISELLE.

Unauthorized copying, systematic downloading, scraping, extraction, reproduction, circumvention of website access controls, or commercial use of website content is prohibited.

Nothing displayed on the website should be interpreted as granting a license to GISELLE intellectual property except for the limited interior-documentation and personal-sharing permissions expressly stated above.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, GISELLE is not responsible for indirect, incidental, special, or consequential loss arising solely from use of the website.

Nothing in these Terms limits any right or liability that cannot lawfully be limited or excluded.

GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

CHANGES

These Terms may evolve as GISELLE's work, editions, acquisition practices, and website develop.

The version in effect at the time of an acquisition will apply to that acquisition together with any terms specifically agreed in connection with the work.

Accepted: All major credit cards, including Visa, Mastercard, and American Express, Apple Pay and Venmo.

Shipping

GISELLE ships original works worldwide.

Each artwork is professionally packaged to museum standards. Shipping costs are determined by the artwork’s size, destination, and handling requirements.

Domestic orders are generally dispatched within 7–10 business days, with tracking information provided upon shipment.

International collectors will receive a shipping quotation for approval before their order is processed.

Installation

Original works are designed to become part of the architecture of a space. Oversized paintings should be installed using appropriate hardware and are best handled by a professional installer.

Installation recommendations and placement guidance are available for residential, commercial, and hospitality projects.

The relationship between artwork and architecture is central to every space.

Guidance is available for collectors, interior designers, architects, and hospitality projects seeking thoughtful artwork placement. Recommendations regarding scale, orientation, and composition are available to help each work become an intentional part of its environment.

Every original painting by GISELLE is a one-of-one work of art.

Each composition is created as a singular expression and is never recreated as a painting. Once acquired, the original becomes part of its collector’s permanent collection and is removed from availability.

Every original is accompanied by a signed Certificate of Authenticity identifying the artwork’s title, medium, dimensions, year of completion, and unique 1/1 designation.

Ownership

Every original work by Giselle is created as a singular one-of-one composition.

Once acquired, the painting becomes part of its collector's permanent collection and is removed from availability. Original works are never recreated as paintings.

Each acquisition is accompanied by a signed Certificate of Authenticity identifying the artwork and its unique 1/1 designation.

FRAGMENTS

The Collection

Fragments are original photographic works created from carefully selected portions of GISELLE paintings. They are not fragments of complete artworks, but independent compositions that reveal relationships of color, texture, gesture, and atmosphere found within the larger work. Each Fragment is identified through the artist's eye, revealing a composition complete in itself.

Authenticity

Every Fragment is released as an original photographic artwork by GISELLE. Each piece is individually titled, signed, numbered within its edition, and accompanied by a signed Certificate of Authenticity identifying the edition number and total edition size. Fragments are distinct works and are never presented as reproductions of original paintings.

Materials

Fragments are produced using museum-quality archival printing processes selected for exceptional color accuracy, longevity, and presentation. Each work is printed on premium archival media using pigment-based inks designed for generations of display under proper care. Available presentation options are listed with each artwork.

Editions

Each Fragment is released in a predetermined limited edition. Once an edition has sold out, no additional prints of that Fragment will be produced. Edition sizes may vary by collection and are identified on both the artwork listing and accompanying Certificate of Authenticity.

Collecting

Fragments may be purchased directly through the website while editions remain available. Every effort is made to maintain current inventory. Orders are carefully prepared for shipment and include a signed Certificate of Authenticity.
